§ 1 Scope and contracting parties
These Terms of Use apply to the use of the Sosta Talents application (talents.sosta.app) by self-employed individuals (“Talent”). The contract is concluded between the individual Talent and Sosta as the provider (§ 13).
The Talents application is intended exclusively for adults who work independently and on their own responsibility. Using it does not create any employment relationship, any engagement as staff, or any brokerage relationship between the Talent and Sosta.
§ 2 Services provided
Sosta provides the Talent with tools to manage their own presence: a personal profile (“Setcard”), availability management, multilingual content, compliance aids, and the option of responding to inquiries from establishments of their own choosing.
Sosta is expressly NOT an agent or intermediary for services and is not a party to any work arranged between the Talent and an establishment or between the Talent and an end customer. Sosta takes no commission on bookings and does not operate algorithmic matching. The Talent may publish their own contact channels (e.g. telephone, messenger); Sosta merely displays them. In addition, the Talent may enable a Sosta chat for guests on their profile: messages in this chat are stored encrypted and deleted 24 hours after the last message in the conversation; after that, an empty entry without any wording remains for up to 90 days. Sosta does not read them and does not analyse them automatically; messages that are reported are retained for review. The chat is a messaging channel only — Sosta does not arrange anything through it, creates no appointments and takes no commission. The Talent can block senders and switch the chat off again at any time.
Trust and verification badges cannot be bought; they are based solely on genuine authenticity signals (e.g. a confirmed telephone number). The order in the directory is determined first by availability: whoever is working right now appears first. Only after that do Talent+ profiles appear ahead of free profiles — at this one point only; every other sort criterion is independent of the plan. Sosta never claims that a Talent is a match for any particular guest or establishment.
§ 3 Registration, legal age and accuracy of information
By registering, the Talent confirms that they are of legal age (at least 18 years old) and have full legal capacity, and that they will themselves meet all official requirements for their work (e.g. registration under the German Prostitutes Protection Act, Prostituiertenschutzgesetz – ProstSchG, where applicable).
The information stored in the profile must be truthful and must not represent another person. The Talent is responsible for keeping their information up to date.
If the Talent states that they work at a particular establishment at a particular time, that statement must be true. The establishment may object to it. The statement is then immediately removed from all public listings and searches, and the Talent is notified. The Talent may enter the correct location or, within 7 days, declare that they do work there; Sosta decides on that declaration. An objection counts as a breach only once the deadline has passed without a declaration or Sosta has upheld the objection. In the event of repeated breaches in relation to different establishments, Sosta will review the case and may block the Talent's access.
§ 4 Free core and “Talent+”
The core of the Talents application is and will remain free of charge. It includes in particular the profile/Setcard, availability management, the inquiry workflow with establishments, the compliance features, and an image gallery within the free allowance.
“Talent+” is an optional paid upgrade offering additional convenience (including an extended image gallery and further profile features). The exact scope of features is shown transparently in the application before purchase.
Authenticity and verification badges are available regardless of the plan chosen; they are never placed behind a paywall. New Talent accounts may try Talent+ free of charge once; the duration and scope of the trial are governed by the conditions published at the time of activation. The trial does not create any obligation to pay and ends automatically.
§ 5 Price, prepayment and term of Talent+
Talent+ is paid for from a prepaid balance. The balance is topped up in advance by bank transfer or SEPA; the applicable monthly price (currently €9.99 per month, including statutory VAT at the current rate of 19 %) is deducted from it once a month. All prices are final prices including VAT; the applicable amount is shown transparently before each top-up and in the application.
The balance is an advance payment for services provided by Sosta and is not a means of payment; it cannot be transferred to third parties. Any balance not yet deducted (remaining balance) is refunded on request — including after Talent+ has ended or the account has been closed, with no minimum amount and no fee. The refund is made to the account from which the balance was topped up; if that is no longer possible, to another account named by the Talent. The request can be made in the application or by email to hallo@sosta.app; Sosta points this out when the account is closed. Statutory rights remain unaffected.
If the balance is insufficient for the monthly deduction, the account immediately reverts to the free basic scope — nothing is deleted, and a new top-up reactivates Talent+ immediately. Payments are processed through the payment methods used by Sosta (SEPA or bank transfer/prepayment). For legal reasons, Sosta deliberately does not use card payment providers whose terms of use exclude this industry.
§ 6 Term, termination and account deletion
The free user relationship runs for an indefinite period and may be ended by the Talent at any time. Talent+ ends at the end of the paid period without any need to cancel; an early cancellation takes effect at the end of the period already paid for (periods already used are not refunded pro rata).
The Talent can permanently delete their account themselves at any time. On request, all personal data are permanently erased (right to erasure, Art. 17 of the EU General Data Protection Regulation – GDPR, in German: DSGVO); details are set out in the privacy policy.
§ 7 Content, rights and public images
The Talent may only upload content (texts, images) for which they hold the necessary rights and which does not infringe the rights of third parties. For uploaded images, the Talent confirms that they are the person depicted or have the express consent of the persons depicted.
Every image the Talent uploads is private at first: only the Talent can see it. An image becomes public only when the Talent activates it; it then appears on the Talent’s profile, in the Sosta directory and on the websites of the establishments the Talent is connected with. How many images can be active at the same time depends on the plan (§ 4) and is shown in the application. If the plan is downgraded, all images remain stored; no more are shown publicly than the plan includes. The Talent can set an activated image back to private at any time; Sosta then removes the public version.
Activated images must stay within the following limit: nudity is only permitted if the nipples and the intimate area are pixelated or blacked out so that they cannot be made out; blurring is not enough. Sexual acts and poses focused on the genitals are not permitted. No lurid or attention-grabbing text may appear on the image. When activating an image, the Talent confirms that it lies within this limit. Sosta’s public pages are only accessible to visitors who have confirmed that they are of legal age.
Content that is prohibited under § 4 JMStV (German Interstate Treaty on the Protection of Minors in the Media), in particular pornographic content, is not permitted on Sosta. Sosta may block or remove images that lie outside the limit and any other content that breaches these terms or applicable law.
If an establishment has created a profile for the Talent and hands it over, the images the establishment uploaded for it are transferred to the Talent’s gallery; they are not deleted in the process. Up to the number included in the plan, they remain activated; the rest are private. From then on, only the Talent decides which of them are activated.
§ 8 Safer sex and advertising restrictions
Sosta only presents offers that require protected sexual intercourse. The Talent undertakes not to offer, advertise or hold out the prospect of unprotected practices in their profile, free texts or messages.
The background is § 32 ProstSchG: advertising sexual services without a condom is prohibited. Sosta therefore does not include such options in its service catalogue; the options available for selection presuppose protection, without this being repeated for each entry.
Sosta does not check free texts in advance. Content that breaches these rules is removed once Sosta is notified of it or otherwise becomes aware of it; in the event of repeated or serious breaches, Sosta may block the account. The decision as to which services are provided in any individual case rests solely with the Talent.
§ 9 Data protection and special categories of data
Profile data may include special categories of personal data within the meaning of Art. 9 GDPR. They are processed only on the basis of the Talent's explicit consent, which can be withdrawn at any time. Data are processed exclusively on infrastructure located in the EU.
Details of the purposes, legal bases, service providers used and data subjects' rights are set out in the privacy policy of the Talents application.
§ 10 Responsibility and liability
Sosta provides the technical platform but is not a party to any work performed by the Talent and does not arrange bookings. The Talent alone (or the respective establishment) is responsible for the content, conclusion and performance of any such work.
Sosta is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. In cases of simple negligence, Sosta is liable only for breach of essential contractual obligations (so-called cardinal obligations, “Kardinalpflichten”), and only up to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded. Mandatory statutory liability (in particular under the German Product Liability Act) remains unaffected.
§ 11 Changes to these terms
Sosta may amend these terms with effect for the future where there is an objective reason for doing so (e.g. a change in the law or new features). The Talent will be informed of changes in good time and in an appropriate form; the current version is identified by its version number and date.
§ 12 Final provisions
These terms are governed by the law of the Federal Republic of Germany. Should any provision be or become invalid, the validity of the remaining provisions is not affected; the invalid provision is replaced by the applicable statutory provision.
